We reserve the right, at our discretion, to change, modify, add, or remove portions of these terms and conditions at any time. - DEFINITIONS AND INTERPRETATIONS
- In these terms and conditions: Reference to “we” and “us” is a reference to Birr Golf Shop Ltd. Reference to “you” is a reference to the purchaser of the Goods from us. “Contract” means the contract between us for the sale and purchase of the Goods which incorporates these Terms. “Goods” means the products and other items purchased by you from us. “Terms” means these terms and conditions.
- These Terms are the only terms and conditions on which we contract for the sale of Goods, and they form an integral part of the Contract between us. If we agree to vary any of the terms, the variation must be in writing confirmed by our duly authorised representative and by you.
- PAYMENT & PRICES
- All prices displayed on our website are quoted in Euro and are inclusive of VAT (Value Added Tax). Packaging and delivery costs quoted separately.
- Published prices are subject to change at any time without notice, final price will be confirmed with your order is when your order is verified.
- Purchased goods will be dispatched once funds are received.
- We accept major credit/debit cards (Visa, Mastercard, American Express) and use Humm®
- DELIVERY
- An estimated delivery date will be given prior to dispatch of purchased goods, however no guarantee can be given, and we will not be held responsible for delivery delays or their effects.
- Goods will be dispatched using An Post. For security purposes, orders must be signed for upon delivery. A tracking service is available upon request.
- We cannot guarantee that all of the goods you order will arrive in a single delivery if you order numerous items. We reserve the right to send you the goods in different consignments.
- Delivered goods must be checked by you to ensure that no damage has occurred in transit. Any issues must be notified to us within 48 hours of their receipt. In these circumstances, the original packaging must be retained for their return.
- PRE-OWNED GOLF CLUBS
- Our pre-owned clubs are not new; some are ex-demo, some are pre-used. The condition of these clubs can vary from good to excellent.
- Pre-owned goods are sold “as is” and cannot be returned on the basis of their condition.
- RETURNS /REFUNDS
- If you are not satisfied with your purchase, we are happy to offer a refund or exchange within 14 days of its receipt.
- Returned products must be in their original packaging, unused, with all tags attached and accompanied by the original order number and the corresponding physical or digital receipt is present.
- Refunds/exchanges do not apply to goods made or modified to your specification or clearly personalised e.g. Custom Golf Clubs, Personalised Golf Balls etc.
- Shipping costs for Returns are not covered by Birr Golf Shop Ltd.
- Where a product is faulty, it must be returned to us in its original packaging, and we will send it to the supplier for inspection. The supplier will either fix the faulty product or a replacement Product will be provided.
- WARRANTY CLAIMS
- Warranty claims are subject to the discretion of the original product manufacturer. Warranty information is included with many manufacturers’ products or may be found on their respective web sites. Please contact Birr Golf Shop Golf Ltd. prior to returning any merchandise for warranty consideration.
- PRIVACY
- If you place an order, you will have to provide personal information to us. We will not disclose that information to any third party without your consent, except for the purpose of processing the order and arranging delivery.
- WARRANTIES & LIABILITY
- The information contained in the Website is for information purposes only and, although we have made every effort to ensure the correctness of the information contained herein, the information available through the Website is provided “as is” and “as available” and without warranties or conditions of any kind either express or implied (including without limitation, the accuracy, completeness or merchantability, quality or fitness for any particular purpose).
- We will not have any responsibility for any damage which occurs to the Goods after you receive them.
- If any defect in any Goods appear within 30 days of delivery, you must notify us as soon as you become aware of the defect, giving us full details. We will then decide, in consultation with you, whether the defect is our responsibility. If so, we may arrange either to repair the defective Goods or to replace them with similar Goods. Any defective Goods to be returned to us must be returned at your expense.
- Birr Golf Shop Ltd. Does not accept any responsibility for any wear and tear, accidental damage or failure by you or by any third party to adhere to any written recommendation provided in relation to the Goods.
- Liability to you for loss or damage shall under no circumstances exceed the total amount you have paid us for those Goods. (However, we acknowledge that we cannot exclude legal liability for death or personal injury which is proved to be due to our negligence).
- Birr Golf Shop Ltd. does not warrant that the Site will operate error-free or that the Site and its servers are free of computer viruses and other harmful elements. If your use of the Site or the material results in the need for servicing or replacing equipment or data, Birr Golf Shop Ltd. is not responsible for those costs.
- THIRD PARTY LINKS
- Where links to other sites and resources are provided by third parties, these links are for your information only. We have no control over the contents of those sites or resources. We make no warranties or representations as to the legitimacy, accuracy or quality of any third party sites and we accept no responsibility for their content, safety, practice or privacy policies.
- CUSTOMER DEFAULT
If you:
• give us any incorrect personal information, or
• fail to make any payment when it is due, or
• cancel any payment, or
• become insolvent, or
• commit any breach of these Terms
then, in any of those events, we have the right to cancel the Contract and recover possession of any Goods which have been supplied for which payment has not been received in full.
- FORCE MAJEURE
- We will not have any liability to you if we are prevented from performing any of our obligations on account of any circumstances beyond our reasonable control including, but not limited to, fire, flood, act of nature, terrorism, war, internet disruption, power failure, strike or difficulty in obtaining materials and/or labour. In any of these circumstances we reserve the right to cancel (or, at our option, to suspend) the Contract.
- GENERAL
- These Terms and the Contract between us are governed by Irish law and in accepting them, you confirm that no other arrangement, agreement or representation applies. Nothing in these terms and conditions affect your statutory legal rights.
